The Fight to Free Kesha Continues

Ever wondered where Ke$ha went and why we haven’t been hearing any music from her lately?

Well, earlier last year, pop star who now just goes by Kesha Rose Sebert, started this ongoing battle against her songwriter-producer, Dr. Luke (Lukasz Gottwald). Kesha alleges that Dr. Luke drugged her and raped her a decade ago and that he has committed ongoing mental and emotional abuse for years. Under contract, Kesha is expected to produce six more albums with Luke. This has put Kesha’s career on standby as she no longer wishes to work with him. Unfortunately, under contract, she cannot continue making music outside Dr. Luke’s purview. Kesha has now been pushing for a preliminary injunction that would allow her to end the contract with Luke’s Kemosabe Records label which is housed under Sony, and save her career.

On Friday, February 19th, 2016, Kesha and Dr. Luke faced New York Supreme Court Justice, Shirley Kornreich. Despite Kesha’s allegations, it appears that the judge was skeptical and has sided with Dr. Luke on this case stating “it’s not reasonable to decimate a contract that was heavily negotiated and typical for the industry.”

Kornreich also heard arguments that Dr. Luke had invested a whopping $60 million in her career and that he has allowed Kesha to record without his involvement. This ultimately influenced her decision, telling Kesha’s attorney that the statement “decimates your argument” and that “my instinct is to do the commercially right thing”. So ultimately, her decision was to not grant an injunction at this time.

Dr. Luke and his attorneys have denied sexual abuse and argued that Kesha’s claims were too vague and came too late. Luke also claimed that Kesha is just attempting to extort him in order to extricate from her contracts with Luke. Kornreich also stated that there was a lack of medical evidence of assault and that she doesn’t “understand why I have to take the extraordinary measure of granting an injunction.”

Kesha’s attorney acknowledged that Kesha has always been given the OK to record with Sony, separate from Luke’s presence, but that the offer wasn’t always a secure promise and that Sony will not promote her if she works with another producer. This offer may seem like Kesha’s only option right now as the judge hasn’t officially ruled the case as dismissed but has reserved the decision for a later time. This gives Kesha the chance to build her case.

Kesha reportedly bursted into tears after the ruling and status of her career.

So what now for Kesha? As of now it is ruled that she must continue working with Sony, but who wants to work for a record label that doesn’t side with you and that’s affiliated with a man you’re scared to death of? Sony has proven that they care more about the money than they do about the protection and well-being of one of their artists. Does that reaction and face look like the face of a liar? This is why so many women are scared to speak up about abuse, due to fear of being accused of lying and being completely shot down.

This fight isn’t just about Kesha anymore. Like she states, “this isn’t just for me. This is for every woman, every human who has ever been abused.  Sexually. Emotionally. Mentally. I had to tell the truth.”

Fans have even set up an arranged #freekesha protest outside the courthouse to boycott Sony and demand the freedom of Kesha.
